18 Month Fixed Price Guarantee

Terms and Conditions

Conditions of Eligibility

Your house is eligible for an 18 Month Fixed Price Guarantee (Guarantee) if the proposed house fulfils the following conditions:

  • The Building Agreement must be signed after 29 July 2025
  • The Building Agreement must be signed by you within 14 days of the quotation being issued
  • Construction Services Australia (CSA) must have released your home to construction (issued you with an OK to Start date under the Building Agreement) within 18 months of CSA signing the Building Agreement
  • You must use your best endeavors to complete all of your requirements under the Building Agreement, including, but not limited to, obtaining development approval, unconditional finance approval and land settlement

Effect of Guarantee

For contracts that are eligible for the Guarantee, clauses 7.1, 7.2 and 7.3 of the Building Agreement will not apply and will be deemed not to form part of the Building Agreement.

Exceeding 18 months

If CSA cannot issue you with an OK to Start date within 18 months of the Building Agreement being signed by both parties, then your Building Agreement will be cancelled, and a new, updated contract will need to be signed The Guarantee does not affect the parties’ rights to terminate the Building Agreement before the OK to Start date.

30 Week Build Time Guarantee

Your house is eligible for the 30-week Build Time Guarantee if the proposed house fulfils the following conditions:

  • The house is one of our standard designs.
  • The house is in the Adelaide metropolitan area.
  • The house is a single-story house.
  • The house is not a split-level house.
  • The house does not require retaining walls or landscaping.
  • The site does not have a greater than 600 mm fall.
  • Unsewered sites and sites requiring demolition are ineligible.


Terms of the Guarantee

If your house is eligible for the Guarantee, then Construction Services Australia will guarantee to complete the construction of your house within 30 weeks of commencing its construction (as described below) (Guaranteed Build Time).

However, where the progress of construction is delayed by one of the causes set out in clauses 6.1 or 6.2 of the Building Agreement, your house will no longer be eligible for the Guarantee. Construction of a house commences on the day the slab of the house is poured.

Construction of a house concludes on the day that Hickinbotham delivers a Certificate of Practical Completion in accordance with clause 15.1 of the Building Agreement.


Effect of Breach of the Guarantee

If the Guarantee is not met, Construction Services Australia Pty Ltd will pay you $250 for each complete week from the expiration of the Guaranteed Build Time until the day construction of the house concludes, for a maximum of (six) weeks. Such payment will be the full extent of Construction Services Australia Pty Ltd.’s liability to you for failing to meet the Guarantee.

The payment will take the form of a deduction from the final progress payment required to take effect formal handover of the house.
