Christmas Giveaway

1. Eligibility to Enter

To be eligible for the giveaway you must be a Hickinbotham Homes client. Entrants must publish a photo to social media in their Hickinbotham home and tag @hickinbotham_homes to be eligible. Hickinbotham Homes employees and associates are excluded from the draw. Entrants should ensure that their Instagram post settings are set to ‘public’ in order for Hickinbotham Homes to receive their entry and communicate with them. 

2. The Prize

The prize is non-refundable, non-transferable and cannot be exchanged for any other prize, cash or credit. If the prize is unavailable, Hickinbotham Homes reserves the right to substitute the prize for an item of equal or greater value. The value of the prize is accurate and based upon the recommended retail value of the prize (inclusive of GST) at the date these terms and conditions are published. Hickinbotham Homes accepts no responsibility for any variation in the value of the prize after that date.

3. Winner Announcement

The competition starts on 2 December 2024 and closes at 11:59 pm ACDT on Thursday, 19 December 2024. The winner will be randomly selected at 25 North Terrace, Hackney SA 5069 on Friday 20 December 2024 at 9:00am ACDT (Draw Date).  The winner of the competition will be notified in writing (including the particulars of how the prize is to be collected) on the Draw Date. 

If the winner does not respond to Hickinbotham Homes and/or collect the prize within 14 days of the Draw Date, the prize will be considered unclaimed and a new winner will be selected. If the winner is not eligible for the prize in accordance with these terms and conditions, Hickinbotham Homes reserves the right to redraw the prize.

4. Data Protection and Publicity

Entrants agree that any personal information provided when entering the competition will be used by Hickinbotham Homes for the purposes of administering the competition and for other purposes as specified in our Privacy Policy https://hickinbotham.com.au/privacy/

The winner's first name and/or social media name will be announced on Hickinbotham Homes, social media and/or digital channels on the day after the Draw Date. By entering the competition, entrants agree to the use of their first name, social media account and/or published imagery for promotional purposes, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.

Entrants acknowledge that use of social media platforms generally is subject to the prevailing terms and conditions of use of the social media platforms. The competition is in no way sponsored, endorsed or administered by, or associated with, any social media platform (including Instagram). 

5. Limitation of Liability

Except for any liability that cannot by law be excluded, Hickinbotham Homes and its personnel and associated entities exclude all liability (including for negligence) for any claim, loss, expense, injury or disappointment arising in any way out of this competition.

If for any reason any aspect of this competition is not capable of running as planned for any reason beyond the reasonable control of the Hickinbotham, Hickinbotham reserves the right to cancel or amend the competition.

Titled Land Discount

The ‘Titled Land Discount’ offer is available only on contracts signed between 4 September 2024 and 29 November 2024.

The Offer is strictly limited to customers who:

1.  Sign a new contract and pay a deposit of $1,000 within seven days of issue.
2.  Present your Certificate of Title (CT) for your specific allotment prior to contract signing. Settlement is not required.
3.  Do not have an existing signed contract with Hickinbotham

The land must be clear and accessible with roads, kerbs and services installed. If the Certificate of Title is not available and the land is not accessible with roads, kerbs and service installed, the promotional discount of $15,000 will be added as a contract variation.

The discount value is not redeemable for cash or credit. The $15,000 discount will be applied as a credit on the final quotation.

Hickinbotham reserves the right to vary and/or withdraw this offer at any time.

30 Week Build Time Guarantee

Your house is eligible for the 30-week Build Time Guarantee if the proposed house fulfils the following conditions:

• The house is one of our standard designs.
• The house is in the Adelaide metropolitan area.
• The house is a single-story house.
• The house is not a split-level house.
• The house does not require retaining walls or landscaping.
• The site does not have a greater than 600 mm fall.
• Unsewered sites and sites requiring demolition are ineligible.

Terms of the Guarantee

If your house is eligible for the Guarantee, then Construction Services Australia will guarantee to complete the construction of your house within 30 weeks of commencing its construction (as described below) (Guaranteed Build Time).

However, where the progress of construction is delayed by one of the causes set out in clauses 6.1 or 6.2 of the Building Agreement, your house will no longer be eligible for the Guarantee. Construction of a house commences on the day the slab of the house is poured.

Construction of a house concludes on the day that Hickinbotham delivers a Certificate of Practical Completion in accordance with clause 15.1 of the Building Agreement.

Effect of Breach of the Guarantee

If the Guarantee is not met, Construction Services Australia Pty Ltd will pay you $250 for each complete week from the expiration of the Guaranteed Build Time until the day construction of the house concludes, for a maximum of (six) weeks. Such payment will be the full extent of Construction Services Australia Pty Ltd.’s liability to you for failing to meet the Guarantee.

The payment will take the form of a deduction from the final progress payment required to take effect formal handover of the house.

Available for all contracts signed from the 4 September 2024.
